**In short:** Yes. Foreign nationals can legally marry in India under the Special Marriage Act, 1954. One of you must live in the district for 30 days before giving notice, and then comes a 30-day notice period. That’s about two months in India, so most couples marry legally at home and hold their wedding ceremony in India.

## Key facts

- **Law:** Special Marriage Act, 1954
- **Residence before notice:** 30 days in the district
- **Notice period:** 30 days
- **Witnesses:** Three

## The short version

You have two routes, and both end with your wedding in India.

1. **Marry legally at home, celebrate in India.** You sign the legal papers at a registry office or courthouse in your own country, before or after the trip. The ceremony in India is the wedding everyone remembers. Most of our couples from abroad choose this. It’s quick and simple, and it’s recognised at home without any extra steps.
2. **Marry legally in India.** You register your marriage under India’s Special Marriage Act, 1954. It can be done, but it takes time. You’ll need roughly two months in India, and paperwork from your embassy.

Neither route changes the day itself. Your guests see the same ceremony and hear the same vows.

## How does the Special Marriage Act work for foreign nationals?

The Special Marriage Act is India’s civil marriage law. Any two people can marry under it, whatever their religion or nationality, as long as they meet the basic conditions. Neither of you can already be married, and both of you must be able to give valid consent. The groom must be at least 21 and the bride at least 18, and the two of you can’t be closely related.

The process runs through the district’s Marriage Officer, who is usually a sub-registrar. There are four steps.

1. **Residence.** At least one of you must have lived in that district for the 30 days immediately before giving notice.
2. **Notice.** You file a notice of intended marriage with the Marriage Officer, who publishes it.
3. **Waiting period.** For 30 days after the notice is published, anyone may object.
4. **Solemnisation.** Once the 30 days have passed, and within three months of the notice, you marry in front of the Marriage Officer and three witnesses. The marriage is then registered.

In practice, that means planning on about two months in India. That’s why most couples take the first route.

## What documents will we need?

Every office has its own list, so we check it with the Marriage Officer before you travel. Usually you’ll be asked for:

- Passports and valid Indian visas
- Proof of address in the district for the 30 days (a letter from your hotel or landlord, for example)
- Birth certificates and passport photographs
- A sworn statement of age and marital status
- If either of you has been married before, a divorce decree or a death certificate
- For foreign nationals, often a certificate of no impediment or single status from your embassy

## Will an Indian marriage be recognised at home?

Usually, yes, but it depends on your own country’s rules. Before you rely on an Indian certificate, check with your embassy, consulate or a family lawyer. This matters most if you’ll need the certificate for immigration, a name change or tax.

## What about a religious ceremony?

Whichever legal route you take, you can have a Hindu, Christian, Muslim, Sikh or civil-style ceremony in India. India’s religious marriage laws apply mainly to people of that faith. So for most couples from abroad, the ceremony in India is the celebration rather than the legal act. We find priests, pastors and officiants who are used to explaining each step to guests in English.

## A simple plan most couples follow

- **6–12 months before:** book the venue and send save-the-dates.
- **1–3 months before:** marry legally at home, quietly or with close family.
- **Wedding week in India:** the ceremony and the celebrations, with no paperwork on the day.

## Questions

### Can two foreigners get married in India?

Yes, under the Special Marriage Act, 1954. One of you must have lived in the district for 30 days before giving notice, and then the 30-day notice period has to pass. Most couples find it simpler to marry legally at home and celebrate in India.

### How long do we need to stay in India to marry legally?

Plan on about two months. You need 30 days of residence before you give notice, and then a 30-day notice period before the marriage can be solemnised.

### Is a symbolic wedding in India a real wedding?

It’s a real ceremony with real vows, but it isn’t a legal registration. If you marry legally at home first, you’re fully married, and the ceremony in India is the celebration.

### Can a foreigner marry an Indian citizen in India?

Yes. The Special Marriage Act covers marriages between Indian and foreign nationals, and the same residence and notice rules apply.

## Will our marriage be recognised at home?

Each country decides this for itself. The table below sets out what the governments of the countries most of our couples come from say. We checked each one on 24 October 2026.

| Where you live | What the government says |
| --- | --- |
| United Kingdom | A marriage that was legal in the country where it took place is recognised as a legal marriage in the UK, with exceptions such as child or polygamous marriages. |
| United States | Recognition is a matter for each state: the State Department tells couples to contact the Attorney General of the state where they live. US embassies and consulates cannot perform marriages. |
| Canada | Marriages legally performed in another country are usually valid in Canada, and you do not need to register them in Canada. |
| Australia | An overseas marriage cannot be registered in Australia, but in most cases it is recognised, if it was valid where it took place and would have been valid under Australian law. |

A symbolic ceremony isn’t a legal marriage anywhere. That’s why couples who only celebrate in India marry legally at home first. If you’ll need your Indian certificate for immigration, a name change or tax, ask that office which form of the certificate it accepts before you travel.

## Couples who share a faith

If you share a faith, a religious ceremony in India can itself be the legal marriage. Take the Hindu Marriage Act, 1955. It covers Hindus, Buddhists, Jains and Sikhs, including Hindus domiciled in India who live abroad, and it says a Hindu marriage “may be solemnized in accordance with the customary rites and ceremonies of either party”. Whether this applies to you depends on your faith, your citizenship and your domicile, so ask a lawyer before you rely on it.

## Registering a marriage held in Kerala

Under the Kerala Registration of Marriages (Common) Rules, 2008, every marriage solemnised in Kerala must be registered, whatever the couple’s religion, unless another law already makes its registration compulsory. You file a memorandum with the Local Registrar of Marriages (Common) within 45 days of the wedding. That’s the registrar of births and deaths at the panchayat, municipality or corporation. You can still register later, but you’ll pay a fine.

## More questions

### Is a wedding in India recognised in the UK?

Generally yes, if it was a legal marriage in India. UK register offices recognise a marriage that was legal where it took place, with exceptions such as child or polygamous marriages. A symbolic ceremony isn’t a legal marriage, so couples who only celebrate in India marry legally at home.

### Is an Indian marriage valid in the US, Canada or Australia?

Canada and Australia usually recognise a marriage that was legal where it took place, and neither registers it again. In the US, recognition is up to each state, so check with the Attorney General’s office of the state where you live.

### Do we need to register a marriage held in Kerala?

Yes. Under Kerala’s Registration of Marriages (Common) Rules, 2008, every marriage solemnised in the state has to be registered with the local registrar within 45 days. That applies whatever your religion, unless another law already requires the marriage to be registered.

### Can a friend or our own officiant marry us in India?

Anyone you like can lead a symbolic ceremony. A legal civil marriage in India is solemnised by the Marriage Officer under the Special Marriage Act. A religious marriage follows the marriage law of that faith.
